1. What air regulations does the state of New Mexico follow?

  • The state of New Mexico adheres to all federal emission standards for hazardous air pollutants (HAPs). National emission standards for HAPs, compliance dates and the air rules and implementation are found in the following U.S. Environmental Protection Agency link: http://www.epa.gov/ttn/atw/eparules.html. The state of New Mexico has a rule limiting the emission of Toxic Air Pollutants (TAPs). This rule can be found in 20.2.72.400-405 NMAC, at: http://www.nmcpr.state.nm.us/nmac/parts/title20/20.002.0072.htm. This list is used for emissions and permitting.

2. Which state organization manages air pollution regulations?

  • Air Quality: The New Mexico Environmental Department http://www.nmenv.state.nm.us/ houses the program on Air Quality http://www.nmenv.state.nm.us/aqb/. Its mission is to protect the inhabitants and natural beauty of New Mexico by preventing the deterioration of air quality. This includes: strategic planning to ensure that all air quality standards are met and maintained; issuing air quality construction and operating permits and enforcing air quality regulations and permit conditions.
