1. What air regulations does the state of South Dakota follow?

  • The state of South Dakota adheres to all federal emission standards for hazardous air pollutants (HAPs). National emission standards for HAPs, compliance dates and their rules and implementation are found in the following U.S. Environmental Protection Agency link: http://www.epa.gov/ttn/atw/eparules.html. The state tests for current pollution levels for particulate matter,ozone,sulfur dioxide,nitrogen dioxide, and air toxics. South Dakota uses the federal list of regulated HAP emissions for permitting and emission inventories.

  • Air Quality Program: The South Dakota Department of Environmental and Natural Resources http://denr.sd.gov/ houses the Air Quality Program http://denr.sd.gov/des/aq/airprogr.aspx. The goal of the Air Quality Program is to maintain air quality levels in South Dakota that protect human health, safety and welfare and the National Ambient Air Quality Standards established through the Federal Clean Air Act. The department achieves this goal by monitoring the ambient air quality throughout the state, permitting businesses and facilities that emit air pollution, and ensuring compliance with the state laws and rules.
